The most common way that assault by auto charges come about is when an individual gets involved in an accident that causes injuries either to themselves, a passenger, or another person, and the person is then found to have been under the influence of alcohol. That is going to be treated as an assault by automobile, which is a criminal charge that almost always carries jail time.

However, the court could come after you on the school zone component, and your criminal charges could be elevated regardless of whether children were present.
