New Jersey Workers' Compensation Laws
New Jersey Workers’ Compensation laws are designed to provide fixed monetary awards to employees injured, disabled or killed on the job.
The laws are supposed to:
-
- Eliminate the time and expense of litigation
-
- Provide benefits for dependents of those workers who are killed because of work-related accidents or illnesses
In some cases, we protect employers and fellow workers by limiting the amount an injured employee can recover from an employer.

Do You Have a Workers Compensation Case?
To receive workers’ compensation benefits in New Jersey, your injury or illness must have occurred “during your employment.” This means you were injured while performing your work, or you became ill because of the conditions at your job.
Here are some examples:
-
- You were in a car crash while driving a work truck.
-
- You threw out your back while lifting heavy boxes.
-
- You fell from a scaffolding while working on a construction site.
-
- You cut your finger while cooking in a restaurant.
The injury must be directly related to your work. Workers’ compensation is a no-fault insurance program. You are entitled to benefits even if the accident was your fault.
If the accident occurred outside your job duties or while you were not at work, workers’ compensation will not likely cover it. If you have a preexisting condition that was made worse by a job-related injury, you may be partially covered for treatment.
Workers Compensation Benefits
If you were hurt at work, your employer must pay for all your medical treatment relating to the injury. This includes hospital bills, doctor’s visits, prescriptions, physical therapy, and medical devices (such as crutches).
If you are out of work for more than seven days, you may be able to collect temporary disability benefits at a rate of 70% of your average weekly wage. Your benefits stop when you return to work or reach maximum medical improvement. Please speak with one of our attorneys today who is well-versed in Somerset County workers’ comp law.
There are additional benefits available to you if you sustain a permanent injury. Additionally, family members of workers who died on the job may be entitled to compensation. Ask our New Jersey workers’ compensation lawyers for more information about death benefits to see if you qualify.
How Can Companies Take Advantage of You?
In New Jersey, insurance companies and employers normally take advantage of an injured worker by doing things like:
-
- Denying a legitimate claim for medical treatment
-
- Discouraging a second opinion
-
- Undervaluing lost wages
-
- Pressuring a worker to return to work prematurely before full recovery
-
- Refusing to accept responsibility for various types of injuries such as those from repetitive stress
In addition, should your employer not provide insurance, the rules covering these instances are technical, and the process may sometimes take a long time to resolve.
Our lawyers can help walk you through the process.

Be advised that it is illegal for employers to fire, lay off, or refuse to rehire a worker in retaliation for seeking Workers’ Compensation benefits.
