Criminal Law Case Examples:
- Police charge defendant with possession of a handgun and purchasing drugs. If the defendant is found guilty it is an automatic state prison sentence. He filed a motion to suppress due to and illegal search and seizure by the police resulting in all criminal charges being dismissed.
- Third offense DUI found not guilty. Mr. Aiello proved that although the vehicle was running the defendant did not have the requisite intent to operate a motor vehicle. Mr. Aiello’s efforts resulted in the defendant avoiding 180 days in jail and 10 years loss of driving privileges.
- Young man denied Pre-trial intervention program. The allegations were that the defendant was dealing drugs to undercover officers. The trial judge agreed with Mr. Aiello and admitted the defendant into the program. The prosecutor appealed the decision to the Appellate Division . Mr. Aiello wrote a brief in opposition and the Appellate Division agreed with his position. Again, the prosecutor appealed to the Supreme Court and once again the Supreme Court agreed with the defendants and Mr. Aiello’s position and he was admitted into the program.
- Defendant had a gun and committed a first-degree robbery. He could have received a prison sentence between 10 to 20 years while serving 85% of the time under (NERA) The no early release act. The plea offer was originally 12 years. Mr. Aiello negotiated with the prosecutor resulting in a second-degree sentence of five years. He then made a motion to the sentencing judge to treat the defendant as a 3rd degree offender and not a 2nd degree offender.
