Resisting Arrest
Resisting arrest is more serious than disorderly conduct. Disorderly conduct can mean up to six months in jail. Resisting arrest can mean as much as 10 years in jail on conviction depending on the nature of the resistance. Some of the factors prosecutors consider in charging a person with resisting arrest are:
- Was flight or fleeing involved?
- Was physical force against the officer involved?
- Was an automobile involved?
Disorderly conduct cases are heard in municipal court. Resisting arrest charges are usually sent to the County Prosecutor’s Office.
Drug Charges
There are many different types of drug charges such as the sale, distribution, or trafficking of narcotics. Possession of drugs or possession with the intent to sell drugs are crimes. - CDS (Controlled Dangerous Substance) Use or Under Influence ‑J.S.A. 2C:35‑10(b).
- Failure to deliver CDS to officer ‑J.S.A. 2C:35‑10(c).
- Toxic Chemicals ‑J.S.A. 2C:35‑10.4.
- Prescription legend drugs ‑J.S.A. 2C:35‑10.5.
- Possession of certain prescription drugs ‑J.S.A. 2C:35‑24.
- Possession of drug paraphernalia ‑J.S.A. 2C:36‑2.
- Discarding hypodermic needle or syringe ‑J.S.A. ‑ 2C:36‑6.1.
