  • These offenses are sent to the County Prosecutor’s office. They generally involve crimes that could mean significant jail time. These offenses can be filed in municipal court but are then transferred to Superior Court.
  • Disorderly Person’s OffensesSample offenses include shoplifting, resisting arrest and possession of marijuana. The sentence maximum is six months and the fine maximum is $1,000.
  • Petty Disorderly Cases. These are the least serious crimes. Harassment and rowdy conduct are two examples. The maximum jail time is 30 days and the maximum fine is $500.

Indictable offenses typically go through the Superior Court System, while less severe disorderly person’s charges are sent to the Edison municipal court.

  • Admission of a young man into a pre-trial intervention program. Aiello contested repeated appeals by the prosecution to deny the man entry into the program.
  • A significant reduction of charges. Mr. Aiello was able to successful negotiate a plea-arrangement on a robbery with use of a gun charge and then further reduce the sentence due to his argument that the defendant be treated as a 3rd degree offender instead of a 2nd degree offender. The originally plea offer of 12 years was thus reduced to just 3 years.
